TERMS & CONDITIONS OF USE

Terms of use

Access to and use of the website www.fortim.ro/corallis (“Corallis Page“) is subject to the terms and conditions set out in this document. Please do not use the Corallis Page unless you agree to these conditions.

The Corallis Page is operated by Fortim Trusted Advisors S.A , a company organized and operating under the laws of Romania, having its registered office in Bucharest, Sector 1, Șoseaua Nicolae Titulescu, nr. 4-8, 2nd Floor, West Wing, with the registration number issued by the Trade Register J40 /3890 /2002 and the unique registration code 14625999 (hereinafter, “we” or “Fortim“).

We reserve the right at any time, without prior notice, to (i) discontinue the operation of the Corallis Site or make any changes we deem necessary, or (ii) modify or supplement these Terms and Conditions, in whole or in part. In order to be aware of any changes to these Terms and Conditions, you may, on each visit to the Corallis Page, view these Terms and Conditions.

These Terms and Conditions govern the relationship between Fortim and you in relation to the submission of the Project (as defined below). They do not create any rights for third party beneficiaries.

If you violate these Terms and Conditions and we do not take immediate action, this does not mean that we give up any rights we have (for example, the right to take action in the future).

If certain terms and conditions are found to be unenforceable or invalid, this will not affect the rest of the Terms and Conditions.

The Corallis page presents information on the Corallis real estate project, belonging to the real estate developer Kesz Investment Romania SRL (“the Project“). Kesz Investment Romania SRL is a company organized and operating under the laws of Romania, with registered office in Cluj Napoca, Calea Turzii nr 178K, et. 2, jud. Cluj, with registration number issued by the Commercial Register J12/6010/2021 and unique registration code 45333986 (“Kesz“).

The www.fortim.ro/corallis website is strictly for information and presentation of the real estate units of the Project and does not represent or create an obligation to contract for Kesz or Fortim. These Terms and Conditions do not govern the contractual relationship between you and Fortim or Kesz with respect to the conclusion of any contracts, in particular any contracts relating to real estate transactions, for which separate contracts between you and Fortim or Kesz, as the case may be, will be applicable only as a result of your contact by a member of Fortim or Kesz staff after registration through the form on the Corallis Page. 

These Terms and Conditions apply exclusively to the use of the www.fortim.ro/corallis website (including the functionality available therein) and not to any other pages of the www.fortim.ro website, which shall remain governed exclusively by the terms and conditions of the www.fortim.ro website, available at the bottom of any page of the www.fortim.ro website. 

Using the Corallis Page

When using the Corallis Page, you must not:

• take any action which may lead to the encouragement, instigation, aiding, abetting or carrying out of any activity of a criminal, fraudulent or other activity prohibited by law;
• use the Corallis Page for any purpose other than personal use;
• use the content of the Corallis Page other than to find information about the Project, to consult the real estate offer associated with the Project and to communicate with us, and for any other purpose expressly arising from the content of the Corallis Page;
• advertise or promote your own or third parties’ products or services, including by distributing unsolicited commercial communications;
• transfer files that contain computer viruses, Trojan horses and/or engage in any other activity that is harmful to the Corallis Page, the company that owns it and/or its providers (e.g. hosting service providers);
• access or attempt to gain unauthorized access to any user accounts linked or associated with the Corallis Page or penetrate or attempt to penetrate the security measures of this Site;
• interfere in any way with any other person’s access to or use of the Corallis Page.

All articles, details, documents and/or illustrations published on the Corallis Page are the exclusive property of Fortim and Kesz, as the case may be, and any use of them is subject to the following conditions:

• if, according to the law, our consent is not required, to comply with the provisions of art. 35 of Law no. 8/1996 on copyright and any other relevant legal provisions;
• use only for purely personal (domestic) purposes permitted by law, exploitation for commercial purposes of any kind is prohibited unless previously authorized by Fortim;
• the articles, details, documents, illustrations, trademarks and/or any other content elements of the Corallis Page are not modified in any way;
• the use should take place without taking out of context any aspects found on the Corallis Page (e.g. illustrations obtained from the Corallis Page should only be used in conjunction with the accompanying text, etc.).

Trademarks and copyright

All trademarks on the Corallis Page are the property of Fortim and Kesz, as the case may be, unless otherwise indicated or otherwise may be perceived as the rights of third parties.

Any unauthorized use, including, but not limited to, copying, reproducing, using, transmitting, selling, licensing or distributing, without the prior written consent of Fortim or Kesz, the content of the Corallis Page, the trademarks thereon or the programming code of the elements of the Corallis Page, for any purpose other than personal use, is expressly prohibited and may constitute a violation of copyright, trademark law or other industrial property rights.

Limited liability

Fortim has obtained, organized and structured the information available on the Corallis Page from internal and external sources using professional diligence. We endeavor to continually update the information available on the Corallis Page, but assume no obligation to do so. 

The information on the Corallis Page is solely for the purpose of presenting the Corallis Real Estate Project developed by Kesz, as well as other related matters.

Fortim makes no representations, warranties or assumes any responsibility, express or implied, for the completeness, accuracy or timeliness of the information on the Corallis Page. We therefore recommend that you verify any information you obtain from the Corallis Page before using it in any way. 

Fortim shall not be liable for any damage or injury resulting from the access or inability to access or the use or inability to use the Corallis Page or from the fact that any person has relied on or used in any way the information available on the Corallis Page.

In addition, no information available on the Corallis Page may constitute a firm offer to contract and may not engage the liability of Fortim, Kesz or any third party, in the absence of express subsequent agreements on our part. 

Websites of third-party providers/links

The Corallis page may contain links/references to third party websites. By providing such links, Fortim does not warrant for their content and does not in any way endorse their content.

Neither does Fortim assume any responsibility for the availability or content of such websites or any liability for any damage or injury resulting from the use of such content in any form whatsoever.

Fortim gives no guarantee that external Internet pages to which reference is made via the Corallis Page will always contain information of sufficient quality. Users access such sites at their own risk.

Details provided by you

The user of the Corallis Page is fully responsible for the content and correctness of the details he/she sends to Fortim through the contact form or any other contact methods, as well as for not respecting any third party rights that may be involved in such details.
